These Terms and Conditions of Use (hereinafter, the “Terms and Conditions”) govern access to, registration with and use of LET’S FÚTBOL, comprising the mobile applications for iOS and Android and the official website https://letsfutbol.com and its subdomains (collectively, the “Platform”), which is owned and operated by Jonathan Pacheco Urueta, a natural person, identified with citizenship card (cédula de ciudadanía) 1.045.692.269, domiciled in Barranquilla, Colombia (hereinafter, the “Operator”).

I. PURPOSE

LET’S FÚTBOL is a free technology tool for organizing amateur football matches: creating clubs, inviting players, scheduling matches and weekly series, confirming attendance, managing the waiting list, recording results and seasons, and following the tournaments in which the User participates.

The User acknowledges and accepts that:

  1. The Operator is a technology intermediary: it does not organize the matches, is not the owner, manager or lessor of the pitches and does not take part in the agreements between players. Each match is organized and played by the Users themselves.

  2. The Operator may modify, suspend or discontinue features of the Platform, temporarily or permanently, giving timely notice to the Users.

  3. Use of the Platform is currently free of charge and does not include in-app payments. If features with a fee are offered in the future, their conditions will be disclosed and accepted before they are purchased.

II. SCOPE AND USER ELIGIBILITY

1. Formation of the agreement

Registration on the Platform confers the status of User and implies acceptance of these Terms and Conditions. The processing of personal data is governed by the Privacy Policy and by the Authorization for the Processing of Personal Data that the User grants upon registering. If the User does not agree, the User must refrain from using the Platform and delete their account.

2. Age of majority

The Platform is intended exclusively for persons over eighteen (18) years of age with legal capacity to enter into obligations under Colombian law. By registering, the User declares to be of legal age. The Operator will delete accounts that belong to minors.

3. Registration and account security

To use the Platform, the User must:

  • Register with their email address or with their Google or Apple account, and provide their real first and last name.

  • Safeguard the confidentiality of their credentials. The account is personal and non-transferable, and actions performed from the authenticated account are presumed to have been performed by its holder.

  • Immediately notify support@letsfutbol.com of any suspected unauthorized access to their account.

III. OPERATION OF CLUBS AND MATCHES

  • Roles: whoever creates a club is its owner and may appoint captains, approve or reject membership requests and remove members. Matches are scheduled by the owner or the captains.

  • Attendance and results: Users confirm their attendance and organizers record the results. The rules on spots, waiting list and results are those displayed by the application.

  • Shared information: the User’s name, photograph and sports profile (except their date of birth), their attendance and the results of matches in which they take part are visible to the members of their clubs and to the participants in their matches. Invitation links show the name and crest of the club or the match details to whoever receives them.

  • Agreements between players: payments, the rental of pitches and any other financial arrangement between Users take place outside the Platform and are the exclusive responsibility of the Users.

Tournaments

LET’S FÚTBOL may operate tournaments between clubs. Each tournament has one or more administrators designated by LET’S FÚTBOL, who configure the tournament and record the results, goals, cards, sanctions and announcements on the basis of the official match sheet. The rules, payments and prizes of the tournament are defined and managed by its organizer, outside the Platform: LET’S FÚTBOL does not process payments and is not liable for the sporting, refereeing or disciplinary decisions of the tournament. The registration of teams and players may be done outside the Platform or, if the organizer so configures it, from the application: the owner or a captain of the club pre-registers the club with the tournament’s registration link, each player fills out their profile sheet and authorizes the sharing of their data with the organizer, and the organizer accepts or rejects each registration and, if so configured, each profile sheet. When the roster is uploaded by the organizer, the organizer declares that it holds the authorization of each registered player to hand over their data and to publish it on the tournament’s public page, to use their mobile number or email to send them the linking code, to display on their ID card the photograph that the organizer uploads and, if the tournament has age ranges, to display their age range. The standings table, the bracket, the suspensions and the prizes shown by the Platform are calculated with the rules configured by the organizer and with the data recorded by the administrators; claims about them must be addressed to the tournament organizer. Anyone who registers from the application declares that the data on their profile sheet is true and, if acting on behalf of a son or daughter, that they are their legal representative.

Tournaments in the application

  • Profile sheet linking: a person listed on the roster of a tournament may link their profile sheet to their account: directly, if the verified email of their account is the one on the profile sheet, or with the code that they receive by SMS or email at the mobile number or email provided by the organizer. An account has only one profile sheet per tournament and a profile sheet, only one account. The organizer can see which profile sheets are linked and may unlink those that the organizer uploaded.

  • Digital ID card: the ID card and its QR code are personal. Its status (eligible, suspended or photo not verified) is calculated with the data recorded by the tournament administrators. Verifying identity at the pitch and deciding who plays is the responsibility of the organizer, who may request an identity document; whoever verifies must scan the QR code with their own mobile phone and check that the page is on app.letsfutbol.com. LET’S FÚTBOL does not guarantee the identity of the players and is not liable for the decisions of the organizer regarding who plays.

  • Attendance and notices: answering “I’m going”, “Maybe” or “I’m not going” to a tournament match is informational for the team and does not change the schedule or the rules of the tournament. Notices about matches, results, announcements and the tournament ID card are sent only to accounts linked to a profile sheet, and all tournament notices can be muted per tournament.

IV. DUTIES, CODE OF CONDUCT AND SANCTIONS

1. Duties of the User

The User undertakes to:

  • Use the Platform in good faith and only for lawful sporting and recreational purposes.

  • Not use mass data extraction tools, bots or automated systems without the written authorization of the Operator.

  • Treat other Users respectfully.

  • Not impersonate third parties or intentionally falsify results or attendance.

  • Not link another person’s tournament profile sheet, not use their ID card or QR code, and not lend their own so that another person may play in their name.

2. Prohibited content

It is prohibited to publish on the Platform (names, photographs, crests or names of clubs and matches) content that is defamatory, insulting, discriminatory, violent, sexual or obscene, that infringes the rights of third parties or that promotes illegal betting, scams or spam.

LET’S FÚTBOL does not tolerate objectionable content or abusive users. The Platform provides in-app mechanisms to report objectionable content and to block abusive users. Any User may report a player, a club or a match from the application, using the “Report” option in its menu, or by writing to support@letsfutbol.com. The Operator will review each report within a maximum of twenty-four (24) hours and, if it is confirmed, will remove or modify the content and may suspend or cancel the account of the person who published it. The reported person is not notified of who reported them.

In addition, each User may block another from the application: they stop seeing that User’s photograph, membership requests and the notices that this User originates, without the latter being notified, and may unblock them in Profile › Blocked. Blocking does not remove anyone from a club or a match: for that purpose, the owner of a club may reject membership requests and remove members from their club. Photographs and crests are automatically analyzed when uploaded and are not published if they contain prohibited material.

3. Moderation, suspension and cancellation

The Operator may remove content and suspend or cancel the account of a User, without any right to compensation, when:

  • These Terms and Conditions or Colombian legislation are breached.

  • Abusive conduct towards other Users is reported and verified.

  • It is ordered by a competent judicial or administrative authority.

V. LIABILITY AND SPORTS RISK

1. Sports risk

Football is a physical contact activity with inherent risks of injury. The User takes part in matches freely and voluntarily, under their sole responsibility, and declares that they have the necessary physical fitness. The Operator does not organize the matches nor manage the sports venues, and therefore is not liable for injuries, damages or losses occurring before, during or after the matches.

2. Service availability

The Operator does not guarantee uninterrupted availability of the Platform or the total absence of errors, and will use reasonable technical efforts to correct them. The Operator is not liable for the accuracy of the information recorded by Users, such as schedules, locations or results.

VI. INTELLECTUAL PROPERTY AND USER CONTENT

1. Property of the Operator

The software, design, trademarks, logos and databases of the Platform are the property of the Operator and are protected by intellectual property laws. Their reproduction, distribution, reverse engineering or decompilation without written authorization is prohibited.

2. User Content

The User declares to be the owner of, or to hold the licenses to, the images, trademarks or crest that they publish. If a third party considers that any content infringes their intellectual property rights, they may report it to support@letsfutbol.com. The User retains the rights to the photographs and crests that they upload, and grants the Operator a non-exclusive, royalty-free license to store and display them within the Platform, solely to provide the service, for as long as the content or the account exists.

3. Intellectual property claims

The Operator does not review in advance the names, crests or photographs published by Users. If content published on the Platform infringes copyright, trademarks or other intellectual property rights, its owner or whoever represents the owner, whether or not they have an account on LET’S FÚTBOL, may claim it by writing to support@letsfutbol.com with:

  • The name and contact details of the owner and, if a representative is acting, proof of their representation.

  • The work, trademark or right that they consider affected.

  • The content claimed: the link or the name of the club, profile or match where it appears.

  • A good-faith statement that such use is not authorized by the owner or by law and that the information in the claim is accurate.

If the claim is upheld, the Operator will remove or modify the content, for example by removing the crest or the photograph or changing the name, and may inform the User who published it. That User may reply to support@letsfutbol.com demonstrating that they have permission or the right to use it; in that case, the Operator may restore it. Repeated infringements may give rise to the suspension or cancellation of the account in accordance with section IV.3.

VII. PRIVACY AND PROTECTION OF PERSONAL DATA

The processing of personal data is governed by the Privacy Policy, published at https://letsfutbol.com/privacy/, in accordance with Ley 1581 de 2012 and its implementing decrees. It describes the data collected, their purposes, the rights of the Data Subject (Titular) and the channels to exercise them.

The User may delete their account from Profile › Delete account in the application or from https://app.letsfutbol.com/delete-account/. If the User is the owner of a club, of an upcoming match or of an active series, they must first transfer or cancel it.

  • Third-party services: the Platform uses third-party services for sign-in (Google Firebase, with Google and Apple), push notifications (Google Firebase and Apple), the sending of account emails and of verification codes by email (Resend) and by SMS (Google Firebase) and distribution of the application (App Store and Google Play). The use of those services is also governed by the terms and policies of each provider. The Operator is not liable for failures, interruptions or changes attributable to such third parties.

  • Store distribution and Third-Party Beneficiaries: When the application is downloaded from the Apple App Store, Apple Inc.’s standard End User License Agreement (EULA) will apply on a supplementary basis. These Terms are entered into exclusively between the User and the Operator, and not with Apple Inc. or Google LLC, which are not responsible for the application or its content: the only party responsible is the Operator. Nevertheless, the User acknowledges and accepts that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and Conditions, and that, upon the User’s acceptance, Apple Inc. will have the right to enforce them against the User as a third-party beneficiary.

VIII. ACCEPTANCE, AMENDMENTS, GOVERNING LAW AND CONTACT

1. Validity of digital acceptance

In accordance with Ley 527 de 1999, the digital acceptance of these Terms and Conditions upon registering or continuing in the application has full legal validity and evidentiary value.

2. Amendments

The Operator may update these Terms whenever necessary. Substantial amendments will be communicated in the application or to the registered email at least five (5) calendar days before they take effect. Continued use of the Platform after that date constitutes acceptance.

3. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Colombia. Disputes will first be attempted to be resolved by direct settlement between the parties or before an authorized conciliation center in the city of Barranquilla; failing that, they will be resolved by the judges of the Republic of Colombia, without prejudice to the rights of the User as a consumer.
